Buteressence B.V. (hereinafter: “Buteressence” or “we”), registered at Rechte Tocht 1, 1507 BZ in Zaandam is responsible for collecting and processing personal data as described in this privacy statement. In this privacy statement we inform you about the way we collect and process your personal data. All personal data that are entrusted to us will be confidential and will be carefully processed. This privacy statement is applicable to all personal data that we collect and process from our (potential) customers, (potential) suppliers and visitors of our website.

Based on various Dutch legislation, we process your personal data for the purposes as described below.

1. To be able to perform (any preparation of an) agreement with you, we use your personal data:

• for processing your request regarding proposals, samples, product specifications etc.;
• for processing your orders regarding aromas and colorants; and
• for purchasing products and services regarding our operational business.

2. In order to comply with the statutory obligations, we use your personal data for the following purposes:

• to comply with applicable law regarding our obligation to keep records for administrative purposes in accordance with the Dutch Civil Code.
  • We keep these personal data for a period of 7 years.

3. Additionally, we use your personal data based on your consent for sending you our monthly e-mails regarding the ‘Aroma tip’ of the month.

We keep these personal data for a period of 3 years.

4. Furthermore, we use your personal data based upon our legitimate interest for organising events for our customers.

We take appropriate technical and organizational measures to protect the confidentiality and security of information we obtain in the course of business with regard to your personal data. Access to such information is limited and policies and procedures are in place, designed to safeguard the information from loss, misuse and improper disclosure.

When providing our services (e.g. delivery of our products) and other business activities, we can engage third parties. In case these third parties process your personal data while performing services and activities for us, we will be responsible for processing your personal data as a controller. For processing your personal data as described in this privacy statement, we may disclose your personal data to the following parties:

• our IT (security) suppliers, being: DKTP Remote Control B.V., Poort80 Hosting Services B.V. and Blending Nederland B.V.; and
• accountants and advisors, being: Ernst & Young LLP.

Under no circumstances will we provide your personal data to third parties for commercial purposes. Only if the law obliges us to do so, we may provide your personal data to regulators and/or (tax) authorities. In all cases we will take appropriate measures to guarantee confidentiality and security of your personal data as much as possible.

Should you no longer wish to receive (commercial) information and offerings, than you can unsubscribe from that specific subscription.

Furthermore, by sending a notice to the address mentioned above, you can exercise the rights mentioned below:

• right of access to your personal data processed by Buteressence;
• right of having your personal data rectified, for example when these data are no longer accurate;
• right to have your personal data deleted, for example after the applicable retention period expired;
• right of limiting the processing of your personal data;
• right to object against processing of your personal data, for example if you no longer wish to receive information about our products or services;
• right of data portability; and
• right of withdrawing your consent at any time (if consent is the basis for the processing). Withdrawing of consent has no retroactive effect. Meaning that the consent is no longer valid as of the moment of withdrawal.

We will respond to your request within a month, unless this is not possible due to the complexity of your request or the amount of requests you submitted. In such an exceptional case we will inform you at the latest within a month and we will extend our reaction period with two months.

In addition to the rights mentioned above you can submit a complaint with the Dutch Data Protection Authority if you believe that Buteressence processes or processed your personal data contrary to the relevant legislation.

6. Cookie policy

The website of Buteressence places analytical cookies from Google. Cookies are small text files that are put on a pc, tablet or mobile phone by an internet page. Buteressence uses functional cookies and analytical cookies to report a website visit.

• Functional cookies

Functional cookies are necessary to ensure that the website functions properly. These cookies are standardly placed and will not be deleted if you do not accept these cookies. Functional cookies ensure care that you remain logged in on our website during your visit.

• Cookies to measure website visits

Analytical cookies enable Buteressence to measure website visits. These statistics provide Buteressence with an overview on how often the website of Buteressence is used, which information visitors are looking for and which pages are most visited. This enables us to see which parts of the website are popular and where we can improve the website.

We analyse and improve the website continuously to make the experience of visitors as pleasant as possible. Buteressence cannot retrace the collected statistics to individuals. These data are always processed and used anonymously. Buteressence uses Google Analytic to obtain insights in the data.

Buteressence entered into a processing agreement with Google The section ‘sharing data’ is turned off by Buteressence and Buteressence does not use Google services in combination with the Google Analytics cookies.

Analytical cookies collect the following data (amongst others):

• updating the amount of visitors of our webpages;
• keep record of the duration of the visit;
• the executed searches on the website; and
• data about your browser and appliance with which you visited our website, such as operating systems and screen size.
